Summary
All photography, video, drone footage, floor plans, and other creative media produced by Manor Creative House are copyrighted works owned by Manor Creative House unless otherwise agreed to in writing.
When you purchase a photography or media package, you are purchasing a license to use the media, not ownership of the copyright. The type of usage rights included depends on the service or package purchased.
MLS / Listing Packages
The real estate agent or paying client receives Temporary Usage Rights for the purpose of marketing the photographed property while it is actively listed for sale or lease. These rights generally end once the property is sold, leased, withdrawn, or otherwise removed from the market.
Commercial / Portfolio Packages
Clients purchasing commercial or extended-use packages may receive broader or permanent usage rights, depending on the package and licensing agreement. This allows the media to be used for ongoing marketing beyond a single real estate listing.
Unless otherwise agreed to in writing, media licensed to one client is non-transferable. Images and videos may not be sold, transferred, gifted, licensed, or distributed to another agent, brokerage, builder, designer, stager, property owner, vendor, or third party for their independent marketing use.
What are “Temporary Usage Rights”?
Temporary usage rights are most commonly included with our real estate listing packages.
The paying agent or client may use the photos, videos, and other media to market the property while the listing is active. This may include:
MLS listings
Zillow, Realtor.com, and other property websites
Social media
Agent websites
Email marketing
Digital and printed property advertisements
Flyers and brochures related to that specific listing
Once the property is sold, leased, withdrawn, or otherwise taken off the market, the listing license ends.
If you would like to continue using certain images or videos for long-term advertising, portfolio use, branding, or other marketing purposes, extended or permanent usage rights may be purchased.
What are “Permanent Usage Rights”?
Permanent or extended usage rights allow a client to continue using licensed media beyond the original property listing.
These rights are ideal for:
Builders • Developers • Interior Designers • Architects • Stagers • Property Managers • Commercial Businesses • Short-Term Rental Owners • Hotels & Hospitality Brands
Depending on the license purchased, media may be used indefinitely across websites, social media, advertisements, digital campaigns, printed marketing materials, portfolios, signage, and other approved marketing channels.
Copyright ownership remains with Manor Creative House unless copyright ownership is specifically transferred through a separate written agreement.
Purchasing permanent usage rights does not give the client the right to resell, sublicense, transfer, or provide the media to another business or individual for their independent marketing use.
Can another agent, builder, or business use the photos?
Not automatically.
Usage rights belong to the client who purchased the photography or media package.
For example, if a real estate agent hires Manor Creative House to photograph a property, the homeowner, builder, interior designer, stager, property manager, or another real estate agent does not automatically receive permission to use those images for their own marketing.
We're happy to provide additional licensing when another party would like to use existing Manor Creative House media.
This allows multiple businesses to legally use the same content while protecting the original client's investment and our creative work.
What happens if a listing changes agents?
The original photography license does not automatically transfer to the new listing agent.
If another agent takes over the listing and would like to continue using Manor Creative House photography or video, a new usage license may be purchased.
This means the new agent may not simply download, copy, or obtain the images from the previous agent, homeowner, MLS, or another website and reuse them.
What if someone uses Manor Creative House media without permission?
If we discover that Manor Creative House photography, video, or other copyrighted media is being used without authorization, we will typically contact the individual or business and request that they:
Remove the media, obtain the appropriate license, or otherwise resolve the unauthorized usage.
Continued unauthorized use may result in additional licensing fees, copyright enforcement, cease-and-desist notices, platform copyright claims, or other legal remedies when appropriate.
Our goal is always to resolve licensing issues professionally and fairly.
A Simple Rule
You purchased the service. You received the license. We retain the copyright.
Our licensing policies allow Manor Creative House to protect the work we create while giving our clients the freedom they need to effectively market their listings and businesses.
If you need extended, commercial, portfolio, builder, hospitality, or permanent usage rights, simply contact Manor Creative House and we'll help you select the appropriate license.
